As cases back up for years in court and the costs associated with litigation rise, more courts are requiring alternative resolutions before a lawsuit is allowed to go to trial, and many contracts specify binding arbitration or mediations as the only means to settle a dispute between the parties to the contract.

Phillip S. Ferderigos, member attorney at Barnwell Whaley, works in the areas of workers’ compensation, construction law, and insurance matters. A native Charlestonian, Phillip brings his restaurant family background to the table to provide not only excellent service towards a resolution, but his jovial style also strives towards amicable solutions as well.

John W. Fletcher, special counsel at Barnwell Whaley, has been practicing law since 1997, primarily in the most complex matters in the firm’s civil litigation and appellate practices.  With experience in all levels of state and federal courts, including the United States Supreme Court, Fletcher now offers mediation services for his clients to settle their matters outside of the courtroom.

Marvin D. Infinger has over 40 years of experience as an attorney and has served as a mediator in over 100 disputes.  South Carolina Super Lawyers has recognized his work as an accomplished Charleston mediator as he is listed in the area of alternative dispute resolution.

Justin P. Novak serves his business and professional clients with extensive experience in a state-wide risk advisory, civil litigation, and dispute resolution practice. He provides both prospective advice and counsel regarding general legal concerns and proactive defense counsel for imminent or active litigation. He also has experience facilitating the early resolution of potential claims.

Randell C. Stoney, Jr., a third-generation Charleston attorney, has focused his 30+ years of law practice on construction law, premises and product liability, and general liability. He holds a Martindale-Hubbell Preeminent rating, (the highest, formerly referred to as AV), and is listed in the 2008 and 2009 editions of Super Lawyers as one of the top attorneys in the state of South Carolina.  Stoney is regularly listed in both Super Lawyers and Best Lawyers. R. Scott Wallinger, Jr. heads up Barnwell Whaley’s trucking and transportation practice and focuses his 25+ year law practice in the areas of trucking defense, professional liability defense, complex business litigation, and mediations. He is certified as a mediator by South Carolina Supreme Court Arbitrator and Mediator Certification Board and is an approved Circuit Court mediator.

The offices of Barnwell Whaley Patterson & Helms, LLC in downtown Charleston, SC have been built with facilitation in mind featuring five conference suites providing smaller spaces for private counseling in separate quarters and ample spaces to bring all parties together to work towards a resolution:

  • Private breakout areas for both parties to consult with counsel in separate quarters
